TERMS AND CONDITIONS

“HAWAIIAN AIRLINES HOLIDAY” PROMOTION TERMS AND CONDITIONS

 

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian and New Zealand residents aged 18 years old or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  3. Promotion commences on 2/10/2012 and entries close at 9:00am (Brisbane local time) on 28/11/2012 (Promotional Period).

  4. To be eligible to enter, individuals must, during the Promotional Period, make a purchase from any participating retailer in the Brisbane International Airport Terminal (excluding any Ineligible Transaction) and receive an official entry card from the retailer. An “Ineligible Transaction” includes transactions from non-participating retailers, and any transaction that includes trolley, bill and car park payments, or tobacco or tobacco related items. One (1) official entry card will be awarded per eligible transaction.

  5. To enter, individuals must then, during the Promotional Period, complete the official entry card by providing all details such as name, email, phone, address and proof of purchase (store name and docket number) and place the entry card in an entry box provided throughout the Brisbane International Airport Terminal.

  6. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per official entry card; and (b) each entry must be submitted separately and in accordance with entry requirements.

  7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  8. Incomplete, indecipherable or illegible entries will be deemed invalid.

  9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  10. The draw will take place at Level 3 Airside, between Gates 80-82, Brisbane International Airport Terminal between 5:45pm – 7:00pm (Brisbane local time) on 28/11/2012. Winners will be notified in writing within two (2) business days of the draw and their names will be published in The Australian on 12/12/2012. The Promoter’s decision is final and no correspondence will be entered into.

    MAJOR PRIZES

  11. The first two (2) valid entries drawn will each win a trip for two (2) adults and two (2) children (12 years or under) to Honolulu, Hawaii valued at up to AU$35,950.50 depending on date of departure (Major Prize). 1 of 2 Major Prizes includes:
    a) return economy airfares from Brisbane, Australia to Honolulu, Hawaii for two (2) adults and two (2) children (12 years or under);
    b) eight (8) nights’ accommodation in a city view apartment at the Outrigger Reef on the Beach, Honolulu or equivalent if not available;
    c) return airport to accommodation transfers;
    d) AU$2,000 Duty Free Voucher for the winner only valid until 12/12/2013; and
    e) AU$8,000 Travelex Cash Passport for the winner only.

  12. Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. A Major Prize must be taken by 12/12/2013 and is subject to booking and flight availability.

  13. Major prize for flights and accommodation must be booked by 31 March 2013 and any further changes in bookings made by the winner will be at their expense. Major Prize winners and their companions must make their own way to Brisbane, Australia to redeem the Major Prize. Any and all costs associated with making their own way to Brisbane, Australia are the sole responsibility of the Major Prize winners and their companions.

  14. During the entire duration of a Major Prize, a nominated parent/guardian must accompany any person under 18 years of age. The Major Prize winners and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The Major Prize winners may be required to present their credit card at time of accommodation check in.If for any reason a Major Prize winner does not take the Major Prize (or an element of the Major Prize) at the time stipulated by the Promoter, then the Major Prize (or that element of the Major Prize) will be forfeited and will not be redeemable for cash.

  15. In the event a Major Prize winner is from Brisbane, Australia, the Major Prize winner will be provided with the opportunity to visit the Brisbane Airport Corporation Pty Limited’s head office, within ten (10) days of the Major Prize draw, where the CEO will present the Major Prize to the Major Prize winner.

    MINOR PRIZES

  16. The next five (5) valid entries drawn will each win a AU$500 Travelex Cash Passport.

  17. The next five (5) valid entries drawn will each win a AU$500 Duty Free Voucher.

    GENERAL

  18. Any ancillary costs associated with redeeming a Travelex Cash Passport or Duty Free Voucher are not included. Any unused balance of a Travelex Cash Passport or Duty Free Voucher will not be awarded as cash. Redemption of a Travelex Cash Passport or Duty Free Voucher is subject to any terms and conditions of the issuer including those specified on the Travelex Cash Passport or Duty Free Voucher.

  19. Duty Free Vouchers can be redeemed at The Nuance Group stores within Australia located at Sydney, Melbourne, Brisbane, Perth and Cairns International Airports and are valid until 12 December 2013. Duty Free Vouchers can be transferred in the Promoter’s sole discretion to a friend or family member of the relevant Duty Free Voucher winner who satisfies the requirements of being an eligible entrant. In the event that the Promoter exercises its discretion to allow a Duty Free Voucher winner to transfer the prize, the transfer will be on the condition that the transferee accepts all terms and conditions set out in these Terms and Conditions and the Promoter may require such acceptance in writing in its absolute discretion. The Nuance Group accepts no responsibility if the Duty Free Voucher is lost, stolen or misused.

  20. The Duty Free Voucher may be used against a single purchase – it cannot be exchanged for cash and change will not be given. A winner or transferee of a minor prize is not entitled to any compensation if that person is unable to use all or any part of a minor prize for whatever reason. Only original Duty Free Vouchers can be redeemed for merchandise – copies will not be accepted under any circumstances.

  21. The customer details on the AU$500 Duty Free Voucher have been left blank in the event a winner’s wishes to transfer to a friend or family member.

  22. When presenting the minor prize, please ensure the winner’s write the relevant full name on the front of each Duty Free Voucher, otherwise it will not be accepted.If a winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  23. Total prize pool value is up to AU$76,901. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

  24. A draw for any unclaimed prizes may take place on 28/2/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing within two (2) business days of the draw and their names will be published in The Australian on 7/3/2013. The Promoter’s decision is final and no correspondence will be entered into.

  25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  27. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

  28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia and New Zealand (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

  30. As a condition of accepting the prize, a winner (and their companions where relevant) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  31. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian and New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant for Brisbane Airport purposes. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

  32. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
