Brisbane Airport Public Car Parks Online Booking Terms and Conditions (“Terms”)
1. These Terms
1.1 These terms and conditions (the "Terms") govern:
(a) the creation and use of your account (the "Account") for Online booking;
(b) payment for use of BAC Car Parks; and
(c) operation and use of your Booking.
By establishment and use of an Account, you agree to these Terms.
1.2 We reserve the right to amend these Terms from time to time. You will be subject to the Terms in force at the time that you use your Account. Whenever you wish to use the Account, please check these Terms to ensure you understand the Terms which will apply at that time. These Terms were most recently updated in November 2023.
1.3 In these Terms:
(a) "BAC", "we", "us" or "our" means Brisbane Airport Corporation Pty Ltd (ACN 076 870 650), registered office at 11 The Circuit, Brisbane Airport QLD 4008 PO Box 61, Hamilton Central, QLD 4007;
(b) "Customer", "you" and "your" mean the individual establishing an account with BAC for use of the BAC Car Parks via online bookings, an agent making a booking for you (if applicable), and (if applicable) any other person who uses a BAC Car Park for the parking of a vehicle via that booking;
(c) “Booking” means any online booking made through our Website for the parking of a Vehicle at a BAC Car Park;
(d) “Booking Confirmation” means the details of your booking provided on your booking confirmation that is made available at the time of booking on our Website, sent to you via email and text message;
(e) “Booking Period" means the period of time covered by your booking, as specified in your Booking Confirmation;
(f) "BAC Car Parks" means the International and Domestic Terminal public car parks including facilities known as P1, P2, International Terminal Car Park, Airpark and Airpark 2;
(g) “Claim” means an action, claim, proceeding, expense or demand;
(h) "Parking Charge" means the fees, charges and other amounts payable in relation to your booking, as specified in your booking confirmation and otherwise incurred by you which include parking fees determined in accordance with this agreement, booking fees, GST, credit card fees and any overtime charges incurred;
(i) "Parking Rates Board" means any board or notice at the entrance to a BAC Car Park displaying the standard charges to be paid for parking;
(j) “Privacy Policy” means our privacy policy available at www.bne.com.au/privacy-policy;
(k) “QR Code” means a machine-readable barcode located on your Booking Confirmation consisting of black and white squares.
(l) “Service Level” refers to self park, valet, premium parking or any other service designation sold on our Website and available in our BAC Car Parks and are:
- Airpark and Airpark 2 – Located off Nancy Bird Way, Brisbane Airport. Remote open air parking with a free transfer bus to both terminals that runs approximately every 10 minutes. Available from 1 – 28 days stay lengths.
- ParkLong – Located at the Domestic Terminal in P1 & P2, majority of spaces undercover. Located at the International Terminal car park, undercover and open-air spaces available. Stay lengths of 4 hours – 60 days available. Walking distance to the terminal.
- ParkPremium – Located at the Domestic Terminal in P1. Stay lengths of 24 hours – 14 days available. Walking distance to the terminal.
- ParkShort – Located at the Domestic Terminal in P1. Maximum 4 hour stays. Walking distance to the terminal.
- Park&Fly – Located at the Domestic Terminal in P2. Stay lengths of 24 hours – 28 days available. Walking distance to the terminal.
(m) "Special Offer" means a promotional offer or other discount additional to these terms and conditions for use in conjunction with a Booking.
(n) "Restricted Access Event" means the requirements of any law or authority in response to a localised, regional, national or global event (including in response to an epidemic or pandemic, public health emergency or communicable disease outbreak), damage to or destruction of the BAC Car Parks, strikes, lockouts, bans or other industrial disturbances, unforeseeable traffic events, airport security event whether a Terrorist Act (as defined in the Terrorism Insurance Act 2003 (Cth)) or otherwise or unpredictable levels of demand which causes a disruption to the ordinary usage of the BAC Car Parks.
(o) "Vehicle" means any vehicle in which you entered a BAC Car Park.
(p) "Website" means our website www.parking.bne.com.au, or www.bne.com.au with its home page or BAC’s parking home page, parking booking engine pages and other parking information pages.
2. Online Booking
2.1 Online booking for a BAC Car Park may require you to create an account personal to you. In making your Booking, you agree to provide us with personal information including your name, email address, phone number and Vehicle registration. You must ensure that all personal information is accurate and current.
2.2 By establishing an account or booking online, you warrant that:
(a) You are legally capable of entering into binding contracts and are not subject to any legal capacity impediment;
(b) Any information you provide to us is complete and accurate; and
(c) You are resident in Australia and accessing online booking from Australia.
(d) You are acting in an individual capacity for personal domestic, non-commercial use.
2.3 We will provide you with a username and password. You are responsible for maintaining the confidentiality and security of accessibility codes, credentials and other security measures for your Account and are responsible for all use and activity carried out under this username. Your content (not including credit card information), may be transferred unencrypted and involve:
(a) transmissions over various networks; and
(b) changes to conform and adapt to technical requirements of connecting networks or devices.
Credit card information is always encrypted during transfer over networks.
3. Operation of Online Booking Service
3.1 Online bookings are made by following the on screen prompts on the Website including selecting the required time period. The online booking service will quote a Parking Charge for your stated duration. The quoted prices vary depending on time of booking and availability of space reflecting market conditions, in particular, a higher price at a time of greater demand. The Parking Charge is fixed when you make your booking. If you overstay your booked time period, you will attract additional charges in accordance with the rates shown on the Parking Rates Board posted at the BAC Car Park entries at the time of your entry to the BAC Car Park.
3.2 Payment for your booking is made by using any of the credit cards shown on our Website. Credit cards are the only form of payment accepted for Online booking service.
3.3 When you provide your credit card details and complete your booking, you are authorising us to charge your credit card with the amount of the Parking Charge.
3.4 If the credit card payment used for your booking fails then your booking will not be processed and will not be valid for use.
3.5 When you book your parking online and pay by credit card you may notice a $1 transaction on your credit card statement. BAC requires to “Authorisation Hold” your credit card to the value of $1 to validate that your credit card details are correct. This $1 transaction is automatically removed within 7 business days (usually faster) and you will not be charged the $1 fee.
3.6 Bookings are only valid when you receive a booking confirmation via email, text message or on the website. We recommend you print out and retain your booking confirmation.
4. Booking period
4.1 Unless your booking is cancelled in accordance with clause 7 of these Terms or otherwise abated according to law, you agree to pay us to use our BAC Car Parks during the Booking Period.
4.2 The Booking Period is a single consecutive unbroken period and BAC grants you a non-exclusive licence for the parking of a Vehicle in the space available to you the car park, subject to these Terms. The rights conferred on you are contractual only and do not give you any interest in the land or the right to lodge a caveat.
4.3 Discounts, credits or other rebates are not made if your stay is shorter than the designated period. If you arrive early or leave late such that your vehicle is parked in a BAC Car Park for any time outside the Booking Period, you will be charged additional fees in accordance with the Parking Rates Board posted at the car park entry at the time of your entry.
4.4 The Parking Rate Boards differ from car parking rates available on the online parking booking and are determined by the then prevailing demand for casual parking.
5. Using your Online Booking
5.1 Your online Booking Confirmation will contain a QR Code. To use your online booking, upon arrival at the BAC Car Park and again at the exit of the BAC Car Park, scan the QR Code on your booking email or text message on the reader at the boom gate.
5.2 Your booking is valid only for a single use in the BAC Car Park and the Service Level specified in your Booking Confirmation.
5.3 If you use a different BAC Car Park or occupy a space outside of the Booking Period or at a different Service Level, you will incur standard charges as displayed at the Parking Rates Board upon entry.
5.4 Online Booking can only be used with the QR Code in the specified manner. If you enter the BAC Car Park using a different method of entry, for example taking a ticket or using your credit card, your booking will not be recognised. You will incur the full parking charge applicable for your length of stay based on the Parking Rates Board posted at the BAC Car Park entry at the time of entry. You may seek a refund of either the parking fee you were charged or the Parking Charge you paid using the online parking system. To receive a refund, you must email us explaining the circumstances (that you were double charged due to use of a different entry method) and provide a copy of your online Booking Confirmation along with proof of additional charge paid at the car park. 6. Functioning of Online Booking Service
6.1 We reserve the right to limit the number of bookings per BAC Car Park, Service Level or person, as specified from time to time on our Website. The online booking service may not be available at all times and availability of BAC Car Parks is subject to our technical, logistical, operational and security requirements.
6.2 Bookings operate only for the defined areas and Service Levels; accordingly, BAC cannot accept bookings for specialised bays such as for higher clearance vehicles, disabled spaces, or easy access bay. Within each area and Service Level, restricted mobility bays are specifically designated.
6.3 Subject to the operation of clause 10, the full refund of your Parking Charge will be the full extent of our liability to you for the functioning of the online booking service.
6.4 You acknowledge and agree that that the Booking Period and the rights afforded you are a personal, non-exclusive licence and cannot be sold, assigned, transferred, novation or resold, either on its own or bundled with other products or services.
7. Cancelling or Amending a Booking
7.1 Up to 24 hours before the start of the booking period, you may cancel or amend your booking by:
(a) logging in to your online account and selecting the relevant options to cancel or amend your Booking yourself; or
(b) if you do not have access to your online account or you have been unable to successfully cancel your booking via your online account, then email [email protected] and provide your full name, email address, and Booking Confirmation number up to 24 hours before the start of the booking period.
7.2 When you cancel or amend your Booking:
(a) Any new Booking will be subject to the applicable rates for the new Booking Period you may select;
(b) Your original Booking will be cancelled. You will receive a cancellation email and a refund will be made to the credit card for the original Booking for the amount of your original Booking (less bank and other third party charges). Please note it may take up to 7 business days to appear back on your credit card, depending on your bank;
(c) The total amount of your new Booking will be charged to your nominated credit card and you will be sent a new Booking Confirmation email and text message. You must use the new Booking Confirmation QR code to enter and exit the BAC Car Park for your Booking to be recognised; and
7.3 If you are amending a Booking that was subject to a Special Offer, your amended Booking must meet all the Special Offer terms and applicable dates. If your amended Booking Period or date of making the amendment is outside the offer terms and/or dates, you may still amend your Booking, however, the Special Offer will not be applicable.
7.4 Subject to clause 10, You are not entitled to a refund for an amendment or cancellation from BAC if you:
(a) did not pay for your booking using your own credit card (for example, if you booked via a third party travel agent who processed the Booking using their own credit card);
(b) do not use the whole or part of the Booking; or
(c) you booked a Special Offer and the terms of the Special Offer do not provide for amendment or cancellation.
8. Terms and Conditions of Car Park use
8.1 In addition to these BAC Car Park Online Terms and Conditions, use of any BAC Car Park is subject to the Brisbane Airport Car Park Conditions of Entry.
8.2 Copies of the Brisbane Airport Car Park Conditions of Entry are displayed throughout the BAC Car Parks and annexed to and form part of these Terms.
9. Abatement and supervening events
9.1 If your access to and usage of the BAC Car Park is, as a result of a Restricted Access Event diminished so that you are unable to use the whole or part of the Booking Period, then:
(a) as soon as practicable after the occurrence of the Restricted Access Event, you must contact BAC at [email protected] and provide notice of the Restricted Access Event and its impact on your Booking Period;
(b) to the extent that BAC is not reasonably able to comply with obligations under this contract we may accommodate your parking needs at our discretion.
9.2 If we are unable to accommodate you in any of the BAC Car Parks at the date your booking begins, we will:
(a) make efforts to organise alternative arrangements to accommodate your vehicle at our cost; or
(b) provide you with a full refund.
10. Liability and indemnity
10.1 You indemnify BAC against all Claims relating to or arising from these Terms to the extent caused or contributed to by the negligence or breach of these Terms by you or any person authorised by you to operate your Vehicle.
10.2 The indemnity in clause 10.1 will be reduced to the extent caused or contributed to by BAC’s negligence or breach of these Terms.
10.3 To the extent permitted by law, You release BAC from all Claims arising from these Terms, except to the extent caused or contributed to by BAC’s negligence or breach of these Terms.
10.4 To the extent allowed by law, neither party is liable to the other for any indirect, economic, special or consequential loss or damage.
10.5 Nothing in these Terms is intended to exclude, restrict or modify any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) and which, by law, cannot be excluded, restricted or modified.
11. Privacy Collection Statement
When you book parking with us, we collect and use your personal information to process and manage your booking, for our business operations and to comply with the law. For some future bookings this may include sending you SMS and email confirmation and booking codes and seeking feedback about our service. The type of information we collect may include your name, email address, number of passengers, vehicle registration, postcode, state, contact phone numbers, travel information (such as terminal and flight numbers), additional products and services that you may purchase and card payment details. If the information is not provided, we may not be able to supply our services to you.
We share your information with our service providers who support us to provide parking and any additional services, to you (such as contractors who provide our booking platform, card payment services and valet services, including the Park&Fly service). It is possible that some of the information collected may be disclosed to service providers outside of Australia including, but not limited to, those with operations in Europe. This may occur, for example, where we have a database hosted outside Australia. We require all third parties that we deal with in Australia and overseas, to take appropriate measures to protect the personal information we disclose to them. This includes complying with the Australian Privacy Act and/or other relevant laws.
We may also use your personal information to conduct marketing activities including for profiling and analytics purposes. Our marketing activities include:
(a) if you have opted in to receive promotional communications, sending you information about news, updates, exclusive offers or other information that may be of interest to you and/or obtaining any consumer feedback or sending surveys in respect of our services (Promotional Communications);
(b) managing and facilitating any competitions with us or our partners that you have entered including any related publicity; and
(c) using your personal information to determine which products and services you may be interested in, to provide you with targeted offers and notifications, to operate and improve the Website and your user experience, and to improve the function and performance of our products and services.
If we send you electronic marketing messages based on your consent or as otherwise permitted by applicable law, you may receive communications in a variety of ways including by email, social media, SMS, MMS, or as push notifications on your device. 12. Governing law
These Terms are governed by and shall be construed in accordance with the laws of Queensland and each party irrevocably submits to the non-exclusive jurisdiction of the courts of Queensland in respect of any dispute arising out of these Terms and/or any contract for use of the BAC Cark Parks.
13. Reading Down
In the event that any provision or portion of any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, the validity and enforceability of the remaining provisions or portions of such provisions of these Terms shall not be adversely affected. The offending provision or any part of such provision shall be read down to the extent necessary to give it legal effect or shall be severed if it cannot be read down, and the remaining part and provisions of these Terms shall remain in full force and effect.
14. Comments and Complaints
14.1 Any comments relating to the booking procedure should be made in writing to us at [email protected]. Please provide us with as much information as possible.
14.2 We will try to answer all complaints within 5 working days. If we cannot, we will tell you when we expect to be able to do so.
14.3 If you wish to make a complaint and it is related to an incident, please do so as quickly as possible after the incident as this will better assist our enquiries.
Brisbane Airport Car Park Conditions of Entry
These Conditions of Entry apply to any person or Vehicle entering this Car Park.
You accept these Conditions of Entry by entering or using the Car Park.
If you do not accept these Conditions of Entry, you must not enter the Car Park. If you cannot turn your Vehicle around, you may enter the Car Park but must exit immediately otherwise a fee will apply for the time spent in the Car Park.
All Vehicles using Valet Services are not guaranteed under cover parking and are subject to inspection at any time, including taking photographs and/or video of the exterior and interior of Vehicles to record any existing damage to the Vehicle and its contents. Vehicles may also be subject to external washing with water. Electronic monitoring is underway at all times in all Car Parks including the use of CCTV and licence plate recognition technology.
1. You use the Car Park at your own risk. BAC may refuse patronage in its absolute discretion.
2. To the extent permitted by law, You release BAC from all Claims arising from your use of the Car Park,
except to the extent caused by BAC’s negligence or breach of these Conditions of Entry.
3. You indemnify us against all Claims arising from your use of the Car Park to the extent caused or contributed to by the negligence or breach of these Conditions of Entry by you or any person authorised by you to operate your Vehicle. This indemnity will be reduced to the extent caused or contributed to by BAC’s negligence or breach of these Conditions of Entry.
4. To the extent allowed by law, neither party is liable to the other for any indirect, economic, special or consequential loss or damage. Nothing in these Conditions of Entry is intended to exclude, restrict or modify any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) and which, by law, cannot be excluded, restricted or modified.
5. Vehicles left in the Car Park must be locked at all times. Parking tickets and valuables must not be left in Vehicles.
6. You must pay the applicable fee for use of the Car Park, Valet Service before leaving the Car Park.
7. BAC may, in its sole discretion, permit Vehicles to exit the Car Park at any time, whether or not a valid parking ticket or credit card is produced.
8. BAC may move or remove a Vehicle for operational or safety reasons or if the Vehicle is parked in an unauthorised spot. You must pay all reasonable costs incurred by BAC in moving or removing your Vehicle.
9. Commercial activities are not permitted in the Car Park unless authorised by BAC in writing in advance.
10. You must comply with all signs and direction markings displayed in the Car Park and with any instructions issued by BAC.
11. The Australian Road Rules and the Airports (Control of On-Airport Activities) Regulations 1997 (Cth) apply and are enforced at Brisbane Airport. Fines are payable for non-compliance.
12. If You provide personal information in the course of using or accessing a Car Park, Valet Services we will deal with that personal information in accordance with BAC’s privacy policy which can be found at www.bne.com.au/privacy-policy.
13. These Conditions of Entry are subject to the laws of Queensland, Australia and you submit to the non-exclusive jurisdiction of the courts of Queensland.
14. In these Conditions of Entry – “BAC” means Brisbane Airport Corporation Pty Ltd and its officers; “Car Park” means this car park and any access ways to and from this car park; “Claim” means an action, claim, proceeding, expense or demand; "You" means any owner or driver of a Vehicle which has entered the Car Park; “Valet Service” means the valet car parking service provided at the Car Park and includes Park&Fly; "Vehicle" means any vehicle in the Car Park and includes any mechanical device on wheels or tracks, its equipment and accessories.
